The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 147, 148, 149, 452, 307, 323, 379, 504, 506, 337 of the Indian Penal Code and 3(I)(v) (x) of the S.C./S.T. Act. It is alleged that Pankaj Singh (non-petitioner) assaulted Ganesh Pandit with axe. The wife of Rakesh Kumar Singh, Rajesh Kumar Singh and Pankaj Kumar Singh caused injury by pelting bricks. Petitioner no. 1 assaulted Simaran Kumari with bricks on the head whereas petitioner Rajesh

Patna High Court Cr.Misc. No.6035 of 2015 (2) dt.13-02-2015 Kumar Singh snatched Rs.1,000/- and Rakesh Kumar Singh snatched gold chain. It is alleged that Parma Nand Singh and his sons abused informant side by calling caste name. It is submitted by the learned counsel for the petitioners that the injury on the Simaran Kumari was found to be simple in nature. There is counter version of the occurrence also and accusation is levelled in the background of serious land dispute. Admittedly, the occurrence took place under construction house of the informant, hence it may not be treated to be a place of public view.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Bhagalpur S.C./S.T.
