BAJANTHRI ORAL JUDGMENT Date : 17-01-2022 This matter is heard via video conferencing due to circumstances prevailing on account of the COVID-19 Pandemic. In the instant petition, petitioner has prayed for the following reliefs:- "(i) For setting aside the enquiry report as contained in Memo No.

1596 dated 29.04.2020 to the extent of charge no. 5, as the enquiry officer without there being any oral evidence has found the charge no. 5 proved against the petitioner.

(ii) For setting aside the order contained in Memo No. 2456 dated

Patna High Court CWJC No.1021 of 2021 dt.17-01-2022 2/2 22.06.2020, passed by the Director Provident Fund Directorate, whereby the petitioner has been dismissed from service.

(iii) The petitioner further prays that after setting aside the order of dismissal, he may be reinstated in service with all consequential benefit as he has not been in gainful employment anywhere after his dismissal.

(iv) For any other relief for which the appellant may be deemed entitled to."

Undisputedly, the petitioner's appeal is pending before the appellate authority. The appellate authority is hereby directed to decide the petitioner's appeal within a period of three months from the date of receipt of this order.

With the aforesaid observations, the writ petition stands disposed off.
