The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 323, 325, 504, 506, 379, 341, 307/34 of the Indian Penal Code.
Accusation against the petitioner is of making repeated assault with bamboo on the head of the informant, whereas the co-accused Sambha Khatoon took away Rs. 5000/- from the pocket of the informant. It is submitted by the learned counsel for the petitioner that for the petty scuffle the accusation has been levelled. The injury report suggests marginal size of injury. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
Patna High Court Cr.Misc. No.11567 of 2015 (2) dt.23-03-2015 Since the final opinion has not been recorded in the injury report brought on the record, let the above named petitioner be released on bail, if the alleged injury is not found to be grievous, in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Azamnagar P.S.
