The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Ghosi P.S. Case no. 155 of 2020 instituted for the offence under Sections 147, 148, 149, 341, 323, 324, 307 and 379 of
Patna High Court CR. MISC. No.34481 of 2020(4) dt.26-10-2021 2/3 the Indian Penal Code.
As per allegation in the FIR, on 22.4.2020 when the informant was encircling his khalihan with bamboo, the petitioners came there, armed with various weapons, assaulted him. On hulla raised by him, his cousins came there for rescue but they were also beaten up by them. Petitioner no. 2 snatched a golden chain worth Rs. 35,000/- from the cousin of the informant.
Learned counsel appearing on behalf of the petitioners has submitted that petitioners are falsely implicated in this case. There is case and counter case between the parties. Both sides have received injuries which are simple in nature. Four injuries are received by Mahendra Yadav, which are simple in nature except one which is on non-vital part i.e. shoulder. Allegations levelled against the petitioners are omnibus in nature. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Ghosi P.S. Case no. 155 of 2020, they will be enlarged on bail on furnishing bail bond of
Patna High Court CR. MISC. No.34481 of 2020(4) dt.26-10-2021 3/3 Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M._1, Jehanabad subject to the conditions as laid down under section 438(2) of the Cr.P.C.
