This application has been filed under Section 482 of the Cr.P.C. against the order dated 10.07.2014 passed in Sessions Trial No. 208 of 2014 arising out of Runni Saidpur P.S. Case No. 29 of 2013, whereunder the 1st Addl. District and Sessions Judge, Sitamarhi rejected the application of the petitioner dated 26.05.2014 for discharge.

On going through the impugned order, it appears that learned Addl. Sessions Judge, after perusal of the statement of the witnesses as detailed in paragraph Nos. 7, 8, 23, 24 and 25 of the case diary rejected the application of discharge after arriving at a conclusion that the witnesses have stated that petitioner along with others, who are the member of M.C.C., fired upon the injured persons. I find no illegality to interfere with the same in extraordinary
