JUSTICE ALOK KUMAR PANDEY ORAL ORDER (Per: HONOURABLE MR. JUSTICE P. B. BAJANTHRI) 06-03-2024 The present MJC is filed for modification of the order dated 05.04.2022 passed in CWJC No. 18876 of 2018. Question of modification of an order of the Court arises only if there is any typographical error or clerical error. On the other hand, learned counsel for the petitioner submitted that petitioner is stated to have deposited rupees four lakh fifteen thousand eight hundred forty nine, pursuant to the order dated 04.10.2018

Patna High Court MJC No.1171 of 2022(3) dt.06-03-2024 2/2 passed by the learned Member (Judicial) Lokayukta. On 25.09.2018, the same has not been brought to the notice of this Court at the time of disposal of CWJC No. 18876 of 2018 on 05.04.2022. Therefore, the question of alteration of the order dated 05.04.2022 in respect of refund of the aforementioned amount by means of modification is impermissible. He has remedy of filing civil review.

2. Accordingly, the present petition stands dismissed, reserving liberty to file civil review.
