The petitioner apprehends his arrest in Complaint Case No. 556(C) of 2013, registered for the offences punishable under Section 498(A) of the Indian Penal Code.
The complainant-wife filed the complaint petition on 06.04.2013 making allegation against her husband-the petitioner that due to non-fulfillment of demand of dowry she was subjected to physical and mental torture.
It is submitted that much prior to filing of this complaint petition, the petitioner filed Matrimonial Suit No. 220 of 2012 for dissolution of marriage. The wife appeared and was contesting the suit. The wife has also filed a case for her maintenance before the Principal Judge, Family Court.
Patna High Court Cr.Misc. No.7397 of 2015 (2) dt.23-02-2015 2/2 It appears that before filing of this complaint case, the petitioner earlier filed Matrimonial Suit No. 220 of 2012, seeking divorce.
Considering the facts aforesaid the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Ara in connection with Complaint Case No. 556(C) of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
