2. The petitioner apprehends his arrest in connection with Special Case No.07 of 2020, arising out of EOU P.S. Case No.04 of 2020, dated 22.04.2020, registered for the offence punishable under Sections 406, 409, 420, 467, 468, 471, 477(A), 120(B) of the IPC and Sections 13(2) read with 13(a) of the PC Act.

The prosecution case, in brief, is that the present case was instituted on the basis of an inquiry report submitted by the Inspector, Economic Offences Unit, Patna, alleging that KCC loans were fraudulently sanctioned by the Bank of Baroda, Dinara Branch, during 2015-2017 on the basis of forged land documents, revenue receipts and mortgage papers. Patna High Court CR. MISC. No.42466 of 2026(3) dt.31-07-2026 2/3 followed, fake documents were accepted, and pre-sanction inspection reports were falsely prepared, causing a wrongful loss of Rs.37,09,000/- to the Bank.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case. It is submitted that the petitioner is not named in the FIR and his complicity surfaced only during the course of investigation. It is further submitted that the entire KCC loan amount availed by the petitioner has already been deposited and the Bank has issued a No Dues Certificate in his favour vide letter dated 09.10.2024. Lastly, it is submitted that the petitioner has no criminal antecedents.
5. On the other hand, the learned APP for the State has opposed the prayer for bail of the petitioner.

Considering the facts and circumstances of the case and taking into account that the petitioner is not named in the FIR, has deposited the entire loan amount and has also been issued a No Dues Certificate by the Bank, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount

No.42466 of 2026(3) dt.31-07-2026 3/3 each to the satisfaction of the learned Special Judge, Vigilance, Patna/Successor Court in connection with Special Case No.07 of 2020, arising out of EOU P.S. Case No.04 of 2020, subject to the conditions as laid down under Section 482(2) of the BNSS as well as the following conditions:
(i) One of the bailors should be the family member/relative/known of the petitioner(s) who shall provide official document/ personal affidavit to show his/her bona fide;
(ii) the petitioner(s) shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his/her/their bail bond by the Trial Court itself;
(iii) the petitioner(s) shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(iv) the petitioner(s) shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of their bail bonds.
7. The bail bonds of the petitioner shall not be accepted by the learned Court below without verification of the petitioner's claim regarding deposit of the entire loan amount and issuance of No Dues Certificate by the concerned Bank. (Ajit Kumar, J) shikha/- U T
