JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 21-07-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner has superannuated in the year 2012. He has been paid Gratuity, Leave Encashment and is getting the Pension, however he has not been paid GPF and Group Insurance. In para 10, he has further made grievance that he is entitled to grant of 3rd ACP but not granted as yet.

Considering the specific grievance of the petitioner, it will be appropriate to dispose of the writ application with a direction to Respondent no. 3 to look into the grievance of the

Patna High Court CWJC No.3471 of 2017 (2) dt.21-07-2017 2/2 petitioner and pass final order.

This writ application is, accordingly, disposed of with liberty to the petitioner to file a detailed representation indicating the grievance with regard to Gratuity and Group Insurance as well as the claim for grant of 3rd ACP under the modified ACP Rules.

If such representation is filed by the petitioner along with a copy of this order, the respondent no. 3 is required to take final decision within a period of three months from the date of filing of such representation. In case, on such decision, the petitioner is found entitled to any monetary benefit, Respondent no. 3 will ensure payment of such monetary benefit within a further period of three months from the date of such decision. With the above observation, this application is disposed of.
