2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 341, 323, 354A, 379, 307, 504 and 34 of the Indian Penal Code.

3. As per the prosecution case, petitioner assaulted on the head of the informant by butt of pistol.

4. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. Prior to institution of this case, Khaira P.S. Case No. 16 of 2023 was lodged by the brother of the petitioner against the informant and his family members. As a matter of fact, on the alleged date of occurrence, the informant and his family members entered the house of the petitioner and abused, assaulted and outraged the modesty of his mother for which Khaira P.S. Case No. 178 of

Patna High Court CR. MISC. No.45736 of 2023(3) dt.13-12-2023 2/2 2023 has been instituted by petitioner's mother against the informant and his family members. Injury caused by this petitioner is simple in nature. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State has opposed the prayer for grant of anticipatory bail.

6. Considering the aforesaid facts and circumstances and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed.

7. Accordingly, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui, in connection with Khaira P.S. Case No.174 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
