JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-03-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 324 and 307/34 of the Indian Penal Code.
The prosecution case is that on 01.02.2016 at 10 PM when the informant was sleeping with his grand-son Pankaj Kumar Yadav, the petitioner and co-accused Bindeshwari Singh came and assaulted with Dabia to the informant. It is submitted by learned counsel for the petitioner that though, two sharp cut injuries have been found but the opinion with regard to the injuries has been kept reserved and the petitioner is aged about 70 years old.
Considering the nature of accusation, this Court is not inclined to grant anticipatory bail to the petitioner.
Patna High Court Cr.Misc. No.12478 of 2016 (2) dt.16-03-2016 2/2 Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Barari P.S. Case No. 17 of 2016 pending in the court of learned ACJM, Katihar.
Accordingly, the application is disposed of.
