JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 30-07-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This application for anticipatory bail arises out of Complaint Case No. 3961(C) of 2013 registered for the offences punishable under Sections 406, 420 and 324 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. It appears that the petitioner had earlier approached this Court seeking anticipatory bail vide Criminal Miscellaneous No. 28530 of 2014, which was disposed of by an order dated 11.12.2014 on the ground that there was no apprehension of his arrest at that point of time. The petitioner was however, directed to surrender before the court below within a fortnight and seek adequate remedy.

No.13326 of 2015 (3) dt.30-07-2015 2/2 A supplementary affidavit has been filed on behalf of the petitioner stating therein that in terms of the order of this Court, he had attempted to surrender before the court below on certain dates but for some reason or the other he withdrew his surrender-cum-bail application.
Keeping in view the nature of dispute and the allegations made, I consider it appropriate to direct the petitioner to surrender before the court below within four weeks from the date of receipt/production of a copy of this order and seek regular bail. If he does so, the court below will be required to consider his regular bail application and disposed it of preferably on the same date of his surrender.
