The petitioner is languishing in custody in a case registered for the offences punishable under Sections 302, 304(B)/34 of the Indian Penal Code. The accusation is of killing the daughter of the informant by all her in-laws family members including the petitioner.
It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is husband of the deceased. There is general and omnibus allegation
Patna High Court CR. MISC. No.39370 of 2022(5) dt.25-07-2023 2/3 against the petitioner. The deceased was a quarrelsome lady and she had made the life of the petitioner and his family miserable and on her persuasion, the petitioner was living with the deceased in a rented accommodation which has been mentioned by the informant in the F.I.R. The petitioner had also filed an informatory petition before filing of the present case and suspected that his wife may commit any crime to implicate the petitioner and his family members. No poisonous substance was found in the viscera report of the deceased. The petitioner is languishing in custody since 03.10.2021. In contra, learned counsel appearing on behalf of the informant and learned A.P.P for the State have vehemently opposed the prayer for bail of the petitioner and submitted that petitioner is husband of the deceased and death was committed within seven years of marriage.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be
Patna High Court CR. MISC. No.39370 of 2022(5) dt.25-07-2023 3/3 released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (T) P.S. Case No. 780 of 2021.
