Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Bidupur P.S. Case No. 248 of 2020 lodged under Sections 304(B), 34 of the I.P.C.
As per the prosecution case, the allegation is against the petitioner that he has caused death of his wife for demand of dowry.
Learned counsel for the petitioner submits that petitioner is the husband and he is in custody since 03.03.2022 and antecedent of the petitioner is clean.
Learned counsel for the State opposes the prayer for
Patna High Court CR. MISC. No.37863 of 2022(3) dt.20-10-2022 2/2 bail and submits that it is a case under Section 304(B) in which petitioner is the husband and allegation of causing death and eloped the dead body for the demand of dowry. In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioner.
The trial court is directed to expedite the trial. The petitioner has liberty to move for bail after one year from today. With this observation, the bail application stands rejected.
