JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-04-2016 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 504, 379 and 506/34 of the Indian Penal Code. The prosecution case is that petitioner no.1 caused injury by iron rod on the head of the wife of the informant namely Bibi Nargis and when the informant went to rescue then he was also abused and assaulted. It is alleged that the petitioner no.2 assaulted on the head of the informant by farsa and co-accused Bibi Soni snatched a silver chain from the wife of the informant. It is submitted by learned counsel for the petitioner that the informant and his wife Bibi Nargis received only one injury which has been found to be simple superficial in nature. Petitioner no.2 is alleged to have caused injury to the informant by farsa but

A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the accusation not being corroborated by the medical opinion, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Araria in connection with Bairgachhi P.S. Case No. 558 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
