BAJANTHRI ORAL JUDGMENT Date : 13-01-2022 This matter is heard via video conferencing due to circumstances prevailing on account of the COVID-19 Pandemic. Learned counsel for the petitioner is hereby directed to furnish a copy of the petition to learned counsel for the respondents.

In the instant petition, petitioner has prayed for the following reliefs:-

Patna High Court CWJC No.548 of 2021 dt.13-01-2022 2/3 "(i) For issuance of writ/writs in the nature of mandamus to immediately grant promotion to the petitioner on the post of Lower Class Clerk since the due date on which other 4th grade employee has been promoted on the post of Lower Class Clerk.

(ii) For commanding the Respondents as to why the petitioner has not promoted on the post of Lower Class Clerk though he obtained the required education for promotion.

(iii) For commanding the Respondents as to why the similarly situated persons have been promoted but the Respondents intentionally and deliberately did not promote this petitioner.

(iv) For any other writ/writs, order/orders, direction/directions as this Hon'ble Court may deem fit and proper as the facts and circumstances of this case."

In support of the aforesaid relief petitioner has submitted representation on 14.06.2011 (Annexure-3). The concerned respondent is hereby directed to examine the petitioner's service particulars read with the representation as to whether petitioner is entitled for promotion to the post of Clerk or not. If petitioner is otherwise eligible necessary order of promotion shall be issued within a period of two months from the date of receipt of this order.
