JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 376/511 of the Indian Penal Code.
The accusation is of attempting to establish forceful physical relationship with the informant.
It is submitted by learned counsel for the petitioner that for the occurrence of 06.08.2014, the complaint was filed on 13.08.2014 which came to be registered as a police case on 06.09.2014. The complaint witnesses are the husband and other neighbours of the complainant against whom the father of the petitioner earlier filed title suit. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named
Patna High Court Cr.Misc. No.11342 of 2015 (2) dt.20-03-2015 2/2 petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sitamarhi in connection with Parihar P.S. Case No. 181 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
