JUSTICE SHIVAJI PANDEY ORAL ORDER 21-01-2015 Heard learned counsel for the petitioner and learned counsel for the State.
In this case, the petitioner is seeking anticipatory bail in connection with Birpur P.S. Case No. 154/2013. A raid was conducted and there found that the petitioner was committed theft of electricity and there the assessment was made Rs. 2,47, 065/-.
The counsel for the petitioner submits that the petitioner is ready to deposit half of the aforesaid amount within two months.
In view of the above, in the event of the petitioner's arrest or surrender before the court below within four weeks from the date of communication of this order, let the above named
Patna High Court Cr.Misc. No.31668 of 2014 (2) dt.21-01-2015 2/2 petitioner be released on provisional bail for two months on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Birpur, Supaul in connection with Birpur P.S. Case No. 154/2013, subject to the condition as laid down under Section 438 (2) Cr. P.C. The one of the bailors will be close relative of the petitioner.
If the petitioner will deposit the aforesaid money then the court below will confirm his bail. If he fails to deposit the aforesaid money then the order will be deemed to have been withdrawn.
