2. The petitioners seek regular bail in connection with Chhatauni P.S. Case No.395 of 2023 lodged under Sections 420, 467, 468, 471 and 120B of the I.P.C. read with sections 30(a) of Bihar Prohibition and Excise Act, 2016./32(ii)(iii)/36/41(i)(ii) of the Bihar Prohibition and Excise Amendment Act, 2018.

3. Learned counsel for the petitioners submits that the bail application of the petitioners has earlier been rejected vide order dated 29.11.2023 passed in Cr. Misc. No. 74709 of 2023 in which liberty was granted to them to renew their prayer for bail 3 months after framing of charge.

4. Learned counsel for the petitioners further submits that the charge has already been framed in this case on 12.01.2024 and 3 months have been lapsed.

5. Counsel further submits that the antecedent of the petitioners is clean.

6. Learned counsel for the State opposes the prayer for bail and submits that it is true that the charge has already been framed in this case.

7. In the present facts and circumstances of this case and the submissions made above, let the petitioners above named, be granted bail on furnishing bail bonds of Rs. 30,000/- (Rupees Thirty Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No.1, East Champaran, Motihari in connection with Chhatauni P.S. Case No.395 of 2023, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

8. With this observation, the bail application stands allowed.
