JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-04-2016 Heard learned counsels for the petitioner and the State. The petitioner has preferred the present application with a prayer for grant of anticipatory bail in a complaint case wherein cognizance has been taken under Sections 420 and 467 of the Indian Penal Code.
It appears from the impugned order that the order of cognizance was passed on 6.1.2005, thereafter the case was fixed for charge but the petitioner failed to appear before the trial court whereafter his bail bonds were cancelled and processes under sections 82/83 were also issued.
It is submitted by the learned counsel for the petitioner that the issue has been settled.
Be that as it may, in the above view of the matter, the
Patna High Court Cr.Misc. No.14926 of 2016 (2) dt.08-04-2016 2/2 present anticipatory bail application is not maintainable which is, accordingly, dismissed in connection with Complaint Case No. CI,512 of 2004 (Tr. No. 581 of 2016) pending in the court of learned S.D.J.M. Sitamarhi.
