JUSTICE SATYAVRAT VERMA ORAL ORDER 24-01-2022 Heard learned senior counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in connection with Bhabua P. S. Case No.126 of 2021, instituted for the offences under Sections 420, 467, 468, 471 of the Indian Penal Code and Section 66(D) of the I.T. Act.

The learned senior counsel for the petitioner submits that the petitioner is in custody since 12.03.2021 and chargesheet has been submitted in the case. The informant (S.H.O. Bhabua P.S.) alleges that the Superintendent of Police, Bhabua vide his office letter dated 11.03.2021 directed the informant to enquire and investigate the letter of appointment issued to Ranjan Kumar Pathak by Nisan Services Private Limited as Data Operator. No.47900 of 2021(2) dt.24-01-2022 2/3 organization was investigated which had its office in a room situated in Shumbha Complex basement and it was found that Sikander Kumar Singh was working as Director and the petitioner was working as Coordinator of the alleged firm. Further several applicants had complained that after typing test conducted by the firm, they were informed that they had cleared the test and were asked to deposit Rs.60,000/- in company's account whereafter fake appointment letters were issued, when the Data Operators are appointed on the recommendation of the BELTRON.

The learned senior counsel for the petitioner, at the outset, submits that co-accused Sikander Kumar Singh has been granted bail by order dated 06.12.2021 in Cr. Misc. No.36467 of 2021, who is alleged to be the Director of the firm while this petitioner is alleged to be the coordinator.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody since 12.03.2021, charge-sheet has been submitted in the case and co-accused has been granted bail as aforesaid, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand)

Patna High Court CR. MISC. No.47900 of 2021(2) dt.24-01-2022 3/3 with two sureties of the like amount each to the satisfaction of learned C.J.M., Kaimur (Bhabua) in connection with Bhabua P. S. Case No.126 of 2021.

The application stands allowed.
