The petitioner seeks bail in connection with POCSO Trial No. 87 of 2022 arising out of Turkauliya P.S. Case No. 484 of 2021 registered for the offence under Sections 363/366(A)/506/376/34 of the Indian Penal Code and Section 4/8 and 17 of the POCSO Act.
The petitioner is said to have kidnapped the girl along with Ravindra Prasad Singh.
The police submitted the Final Form and exonerated the petitioner. The Magistrate has differed with the Final Form and taken cognizance. The petitioner is in custody
Patna High Court CR. MISC. No.41866 of 2023(2) dt.14-07-2023 2/2 since 26.04.2022.
Learned A.P.P. has vehemently opposed the prayer for bail.
Considering the period of custody, this application for regular bail is allowed.
Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 6th Additional Sessions-cum-Special Judge, POCSO, Motihari, East Champaran in connection with POCSO Trial No. 87 of 2022 arising out of Turkauliya P.S. Case No. 484 of 2021.
