ANJANA MISHRA ORAL ORDER 21-01-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in Mohiuddinnagar P.S. Case No.201 of 2013 for the offences under Sections 147, 148, 149, 341, 323, 307 and 379 of the I.P.C. It is submitted on behalf of the petitioners that the allegation of mar pit are general and omnibus in nature and any particular injury can not be attributed to this petitioner. It is further submitted that the allegation of theft has merely been brought by the informant in order to attract the provision of Section 379 of I.P.C. which are bailable in nature.

Considering the fact that there is history of enmity

No.32453 of 2014 (2) dt.21-01-2015 2/2 between two vendors and also the fact that the petitioners have no criminal antecedent, let both the petitioners, above named, in the event of their arrest or surrender before the court below within two weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the C.J.M., Samastipur, in Mohiuddinnagar P.S.Case No.201/13 subject to the conditions as laid down under Section 438 (2) of Cr.P.C.
