2. Petitioners apprehend their arrest in connection with Rajauli P.S. Case No. 563 of 2021 dated 09.11.2021, registered for the offence punishable u/s Section 414 of the Indian Penal Code and under Section 30(a)(d)/41 of Bihar Prohibition and Excise Act, 2016, pending in the court of learned Exclusive Special Excise Judge-IInd, Nawada.

3. After some arguments, learned counsel for the petitioners seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, this application is dismissed as

Patna High Court CR. MISC. No.39491 of 2023(2) dt.28-07-2023 2/2 withdrawn.

6. However, if petitioners surrender before the learned Court below within six weeks from today and seek regular bail, the learned Court below shall pass order on the same day in accordance with law without being prejudiced by this order considering the fact that similarly situated co-accused have been granted anticipatory bail by a co-ordinate Bench of this Court.
