The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 379/34 of the Indian Penal Code and 3(I) (X) of the S.C./S.T. (Prevention of Atrocities) Act.

Accusation is of assaulting the informant and taking away Rs. 10,000/- and chicken of the informant. It is submitted by the learned counsel for the petitioners that petitioners' side earlier filed Sherghati P.S. Case No. 241 of 2014 and thereafter the present case has been lodged against the petitioners and no injury was caused to the informant. Statement to that effect has been made in para-6 of

Patna High Court Cr.Misc. No.8721 of 2015 (2) dt.02-03-2015 the petition. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent. The First Information Report was registered on 29.08.2014 but the same reached to the learned Sub Divisional Judicial Magistrate, Sherghati on 01.09.2014 which suggests that First Information Report has been registered by ante dating.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Sherghati, Gaya in connection with Sherghati P.S. Case No. 240 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code. (Dinesh Kumar Singh, J) P.K./- U T
