JUSTICE ASHUTOSH KUMAR ORAL ORDER 06-01-2021 Heard Mr. Vyas Kumar Mishra, learned counsel for the petitioner and the learned APP for the State. The petitioner, who is in custody since 13.07.2020, seeks bail in connection with Gopalpur P.S. Case No. 87 of 2020, dated 09.05.2020, instituted for the offences under Sections 188, 269, 270, 272, 273 and 420 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Four persons are said to have been arrested on chase by the police for being in possession of liquor. The name of the petitioner has transpired in the confession of

Patna High Court CR. MISC. No.35068 of 2020(2) dt.06-01-2021 2/2 those arrested accused persons. With respect to the petitioner and two others, it has been alleged in the F.I.R. that they could manage to run away from the clutches of the police.

There is no recovery from the possession of the petitioner.

In the cases in which the petitioner was earlier made accused, he has been granted bail.

Considering the period of custody of the petitioner and the nature of accusation against him, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-II-Cum-Special Judge, Excise, Gopalganj in connection with Gopalpur P.S. Case No. 87 of 2020.
