This is a petition for grant of anticipatory bail in a case under Sections 147, 148, 149, 341, 323, 448 and 365 of the Indian Penal Code.
It is alleged that the husband of the informant was kidnapped by the petitioners and others. It is also alleged that the victim was assaulted and left him in the Jungle. Learned counsel for the petitioners submits that petitioners are the prosecution party in a murder case and this case has been lodged to put pressure upon the petitioners and the victim himself returned back. The injuries are though on the hand which has been shown to be fracture of right fibula
Patna High Court Cr.Misc. No.33542 of 2014 (2) dt.06-02-2015 which is not on the vital part of the body.
Hence, having regard to the facts and circumstances of the case, the petitioners, above named, are directed to be released on anticipatory bail in the event of their arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sherghati, Gaya in connection with Barachatti P.S. Case No. 73 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr. P. C.
