The petitioners namely Surendra Singh and Rajesh Singh apprehend their arrest in L.N.M.U. P.S. case no. 06/16 registered under Sections 448, 380, 341, 323, 386/34 of the Indian Penal Code.
The informant alleged that he was running a security service in the name and style of M/s Industrial and Personal Security Service. On 28.12.2015, he closed the office of the security service and went to his house. At about 6.00 p.m., his staff Satish Kumar disclosed that the petitioners broke open the lock of the office and took out different articles from the office. Learned counsel for the petitioner submits that the

The petitioners are tenants of the house allotted by Kameshwari Priya Poor Home Trust. The petitioners have annexed documents showing payment of rent and electricity bill. The informant wants to run a shop from the house of the petitioner, and, for that, this false case has been lodged, that too, on 05.01.2016 although the occurrence took place on 28.12.2015.
Considering the facts that the F.I.R. was lodged after eight days of the occurrence and petitioners are co-villagers of the informant, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in L.N.M.U. P.S. case no. 06/16 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
