JUSTICE SUDHIR SINGH ORAL ORDER 17-03-2017 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is apprehending her arrest in connection with Piprahi P.S. Case No. 07 of 2016 for the offences instituted under Sections 420, 409 and 188 of the Indian Penal Code. The allegation against the accused persons including the petitioner is of misappropriation of government money to the tune of Rs. 6,01,091/-, which were given to them for construction of school but no construction work is being done by the accused persons.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The

Patna High Court Cr.Misc. No.10391 of 2017 (3) dt.17-03-2017 2/2 petitioner has falsely been implicated in the present case, due to mistake of fact. The money was given to the Headmaster of the school and he has already completed the construction work of the school. The other co-accused have been granted anticipatory bail vide Cr. Misc. No. 984 of 2017 and Cr. Misc. No. 5548 of 2017. On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named be released on anticipatory bail in the event of her arrest or surrender before the learned court below within a period of six weeks from today in connection with Piprahi P.S. Case No. 07 of 2016 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Vishal Kumar, Judicial Magistrate, Sheohar, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
