JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 14-02-2022 Heard the parties through video conferencing. The petitioner seeks bail in anticipation of his arrest in connection with Gaighat P.S. Case No. 174 of 2021 instituted for the offences punishable under Section 7 of the Essential Commodities Act.

Learned counsel for the petitioner submits that the pick-van was seized and the driver of the pick-van which contains 56 bags of rice has mentioned the name of the petitioner, having a fair price shop in the area. Learned counsel submits on the basis of such statement, the petitioner cannot be said to be committed an offence.

Without going into the merits and taking into consideration the above, I am inclined to allow the petitioner on

Patna High Court CR. MISC. No.48881 of 2021(2) dt.14-02-2022 2/2 bail, in the event of arrest he shall be released on anticipatory bail, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
