Mr. Bharat Lal, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 26-05-2021 Heard the parties in virtual Court proceeding. The petitioners are languishing in custody for the offences punishable under Sections 147/148/149/341/302 of the Indian Penal Code and Section 27 of the Arms Act. Allegation of commission of fire-arm injury is against other named accused persons. Allegation against petitioner Pappu Yadav is that he had caught the deceased along with another person when several other accused made firing on the deceased.

Submission is that the allegation is unbelievable that when several person were firing petitioner Pappu would have put hold on the deceased. Investigation of the case is already complete.

No.3377 of 2021(3) dt.26-05-2021 2/2 Considering the facts of this case, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Salkhua P.S. Case No.203 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below. (b) The petitioners shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.

(c) The petitioners shall not leave the country without permission of the trial Court.
