ANJANA PRAKASH ORAL JUDGMENT Date: 01-03-2016 The Petitioner seeks quashing of the order dated 12.02.2013 passed by the Sessions Judge, Bhagalopur in Cr. Rev. No. 349 of 2012 by which it has refused a petition under Section 125 Cr.P.C. filed by the Opposite Party No. 2 as well as order dated 04.07.2012 passed by the Sub-divisional Judicial Magistrate, Banka in Misc. Case No. 17 of 2010.

On perusal of the impugned order, I do not find any reason for interference with the same. The application is disposed off with liberty to the Petitioner to press all these points before the Court below.

I am informed that the Opposite Party No. 2 is not appearing in the Court below which fact shall be verified by it and he shall follow the appropriate procedure so as to conclude the proceeding within a reasonable time.

With the aforesaid observations, the Application stands disposed off.
