The petitioner apprehends his arrest in Baisi P.S. Case No. 185 of 2016 instituted for the offence under sections 414, 467, 468, 471 and 420 of the Indian Penal Code. It has been submitted on behalf of the petitioner that though the petitioner is said to be the owner of Singh Trading Telta, Balrampur, Katihar but he was neither owner nor driver of the truck on which coal was loaded without valid papers. It has further been submitted that amount of fine has already been realized by the department (Annexure-3) series. From the allegation in the written report, it appears that total six trucks were apprehended loaded with coal and on verification, it was found they have no valid documents.

This petitioner allegedly is owner of Singh Trading Telta Katihar. He was neither truck owner nor driver of the truck which has been found loaded with coal.

Considering the aforesaid facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Baisi P.S. Case No. 185 of 2016 ,he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.II, Purnea, subject to the conditions as laid down under section 438(2) Cr.P.C.
