JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-11-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 364/34, 302, 201 of the Indian Penal Code.

As per the prosecution case, husband of informant had gone with the petitioner and co-accused, Kundan Kumar, but he did not return home. Later on his dead body was found. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case only on suspicion. Save and except suspicion there is no material against this petitioner. It is submitted that only material that has come against this petitioner is his confessional statement recorded in Hajipur Town PS case no. 1108/2019. Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, Vaishali at Hajipur in connection with Ganga Bridge PS case No. 02/2019.
