The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a), 41(1)(2) and 47 of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, 328.5 litres of IMFL is said to have been recovered from the pick up van purchased by this petitioner.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The registration of the said vehicle has still not been transferred in the name of this petitioner. No incriminating article has been recovered from the vehicle in question. The petitioner is in custody since 25.7.2021 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts of the case, chargesheet having been submitted in the case and the petitioner not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Pusa P.S. Case no.92 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cumSpecial Judge (Excise Act), Samastipur.
