JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-07-2019 The petitioner in the present writ petition has challenged the order dated 13.3.2018 passed by the Deputy Development Commissioner, Madhepura transferring the petitioner.

The petitioner had earlier approached this Court by by filing CWJC No. 18634 of 2016 which was disposed of on 5.9.2017. Thereafter the petitioner approached the District

Patna High Court CWJC No.8654 of 2018(3) dt.02-07-2019 2/2 Programme Officer, Establishment, Madhepura and other authorities including the Director, Primary Education. The petitioner's representation was rejected on 13.3.2018. Thereafter the petitioner filed an application for reconsideration of his case before the Deputy Development Commissioner, Madhepura. The DDC rejected the claim of the petitioner. Transfer is an incidence of service and in transfer matters indulgence is only permissible if the transfer order is without jurisdiction or mala fide.

In view of the above, the Court is not inclined to interfere with the order of transfer.
