Patna High Court CWJC No.1482 of 2017 dt.18-03-2017 2/3 The petitioner, who was appointed as Pro-Vice Chancellor of J. P. University, Chapra by the order of the Hon'ble Chancellor dated 19.02.2013 claims to have taken charge of his office on 22.02.2013. His further claim is that after the decision of the Hon'ble Supreme Court in Civil Appeal No. 6831 of 2013 dated 19.08.2013, he was removed from the post and, thus, till that date he should be paid his salary for having performed the duties of Pro-Vice Chancellor of J. P. University. Learned counsel further submitted that in this regard, he has submitted a representation to the Hon'ble Chancellor on 04.09.2013 but till date payment has not been made to him. He further submitted that his salary is due from 01.03.2013 to 19.08.2013.
Learned counsel for the respondents submitted that the Hon'ble Supreme Court, by order dated 18.03.2013, had passed the order restraining the petitioner and others from functioning on their post and had also made alternate arrangements and, thus, the petitioner is not entitled to any payment, at least from that day. Be that as it may, in view of the position that facts have to be looked into and the petitioner has already represented before the Hon'ble Chancellor, this Court deems it appropriate to dispose off the writ petition with a request to the Hon'ble Chancellor to dispose off the representation filed by the petitioner expeditiously.
