The petitioners have moved the Court for a direction to unseal/open the lock of their branches at Barh, Patna which has been so done by the respondent no. 9.

From the records, it transpires that the sealing has been done pursuant to lodging of Barh P.S. Case No. 89 of 2013 dated 28.04.2013. In view of the aforesaid, the matter being subjudice before the Court concerned, this Court does not deem it

Patna High Court CWJC No.13688 of 2014 dt.14-02-2017 2/2 appropriate to interfere in the matter. The attention of the Court has been drawn to order of a co-ordinate Bench of this Court dated 15.04.2014 passed in C.W.J.C. No. 4304 of 2014, where a premises has been directed to be unsealed. The Court would only observe that in the present case, where the allegation relates to dealing in investments made by the common citizen of India in an unauthorized manner, without confirming to any safeguard, the Court would decline to exercise its extraordinary prerogative writ jurisdiction. In view thereof, the writ petition stands disposed off with liberty to the petitioner to raise the matter before the appropriate forum in accordance with law, at the appropriate stage.
