The petitioner being the father of the husband of the victim is apprehending his arrest in a case registered for the offences punishable under Sections 120B/34 and 304B of the Indian Penal Code. The accusation is of killing the sister of the informant after one year of marriage for nonfulfillment of dowry demand. It is alleged by the informant that the sister was being assaulted by in-laws family when demand of dowry was made by the husband of the victim. Ultimately, the informant came to know that the sister was administered poison.
It is submitted by learned counsel for the petitioner that the petitioner works at Govindgarh
Patna High Court Cr.Misc. No.8519 of 2015 (2) dt.27-02-2015 2 / 2 in the province of Punjab. The post mortem report does not reflect any external and enternal injury particularly the resisting injury in the background of fact that the accusation is of administering poison to the victim.
Considering the thrust of accusation against the husband of the victim and post mortem report, let the petitioner, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Sahiyara P.S. Case No. 117 of 2014 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Sitamarhi, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
