JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 18-05-2017 Mithila Mithilesh Sanskrit Prathmik-Sah-Uchcha Vidyalaya, in the District of Darbhanga is being claimed to be proposed Sanskrit School. The students of the said School have been asked to appear for Madhyama Examination, 2017 through a recognized School.

2. The present writ application has been filed on behalf of the Headmaster of the said School claiming that examination fees and forms should be allowed to be deposited through the said School and not through any other

recognized School.

3. In between the fight of the Management Committee of the School and respondents in respect of its claim for the students to be allowed to appear through the said School for Madhyama Examination, the students of the said School are going to suffer inasmuch as their fees and forms have not been accepted, last date having already expired on 05.05.2017.

4. This is not the time to consider the petitioner's claim whether the filling of the examination forms and deposit of fees are to be done through the petitioner's School or a recognized School since the examination is going to be held in recent future for which examination fees and forms have already been deposited in other schools and last date of submission of examination fees and forms has expired.

5. In the facts and circumstances of the case I dispose of the writ application with an observation and direction that the Board shall accept the fees and forms of the students of the School if deposited within one week from today and shall not refuse to accept on the ground of cut-off date for the said purpose having already expired.

6. I have not gone into the claim of the petitioner that fees and forms should have been accepted through this School itself and not through the recognized School, which

claim the petitioner shall have liberty to raise in future in any other appropriate proceedings.

7. This application stands disposed of with the above observations and directions.
