JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Jamalpur Police Station Case No. 161 of 2013 registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code and 47 (A) of the Excise Act.

Taking into consideration that huge quantity of country made liquor was recovered from the house of the petitioner, I am not inclined to grant privilege of anticipatory bail, accordingly, his prayer for bail in connection with Jamalpur Police Station Case No. 161 of 2013, pending in the court of learned Judicial Magistrate, 1st class, Munger stands rejected. However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail petition.
