The petitioner seeks bail in connection with Excise Case No. 261 of 2020 (Excise P.S. Case No. 261/2020) instituted for the offences under Sections 30(a) and 56 (a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. It appears from the prosecution report that 80 litres of liquor has been recovered from a bag which was being carried on a motorcycle by the petitioner. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.34526 of 2020(2) dt.21-12-2020 2/2 that the recovery has wrongly been shown in the name of the petitioner.

He is in custody since 28.06.2020 and does not have criminal antecedents.

Regard being had to the afore-stated facts, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Gaya, in connection with Excise Case No. 261 of 2020 (Excise P.S. Case No. 261/2020).
