The petitioners, namely, Sarifan Khatoon and Mahammad Seraj, apprehend their arrest in Complaint Case No. 1792/2012 registered under Sections 323, 379, 417 and 406 of the Indian Penal Code.

The complainant alleged that the petitioners took Rs. 85,000/- for arranging VISA but the petitioners did not hand over VISA to the complainant.

Learned counsel for the petitioners submits that the petitioners are step-mother and step-brother of the complainant. On account of family dispute, this complaint case is filed making

Patna High Court Cr.Misc. No.33019 of 2014 (2) dt.09-02-2015 2/2 false and frivolous allegations.

Considering the facts that there is no chit of papers to show that the petitioners took money from the complainant and the petitioners are step-mother and step-brother, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri R.K. Tripathi, Judicial Magistrate, Gopalganj in Complaint Case No. 1792/2012, corresponding to Tr. R. No. 3085/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
