ANJANA PRAKASH ORAL JUDGMENT Date: 03-05-2016 The Petitioner seeks quashing of the order dated 10.12.2015 passed by the Additional Chief Judicial Magistrate, Aurangabad in Baroon P.S. Case No. 57 of 2015 (G.R. No. 714 of 2015) by which he has rejected the application of the Petitioner filed to defreeze his account of the Indian Bank SB A/c No. 590745284 and C.C. Account No. 5907353119.

It has been submitted that the Petitioner had the following Accounts in Indian Bank, Kochar Branch, Aurangabad being SB No. 590745284 and also an CC Account No. 590753119 which has been frozen at the instance of the

Patna High Court CR. REV. No.289 of 2016 dt.03-05-2016 Investigating agency of Baroon P.S. Case No. 57 of 2015. The prayer for defreezing the Accounts has been rejected by the Judicial Magistrate, 1st Class, Aurangabad by order dated 10.12.2015.

In the interest of justice, the Indian Bank authorities are directed to permit the Petitioner to operate his SB Account No. 590745284 after his giving an undertaking before the Court below that he shall deposit the entire amount which is subsequently decreed by the Court in the certificate case. It will be open to the Indian Bank not to permit further cash credit to the Petitioner who is an account holder of CC Account No. 590753119.

With the aforesaid observations, the Application stands disposed off.
