The petitioner seeks bail in connection with Biraul P.S. Case No. 412 of 2020 instituted for the offences under Section 30(a) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 26.12.2020, is a person with clean antecedent and charge-sheet has been submitted in the case. Allegation is of recovery of 573.09 litres of liquor from a Bolero pickup van.

Learned counsel for the petitioner submits that the petitioner was a mere passenger and as such came to be implicated when the search was being made.

Patna High Court CR. MISC. No.47921 of 2021(3) dt.22-03-2022 2/2 Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cumSpecial Judge (Excise), Darbhanga in connection with Biraul P.S. Case No. 412 of 2020.
