JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 01-04-2016 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Gogri (Paura O.P.) P.S. Case No.193 of 2015 registered under Sections 147, 341, 323, 447, 307 and 506 of the Indian Penal Code.

It is contended that there is omnibus and general allegation against the petitioners that they assaulted the informant. It is not mentioned in the FIR that the petitioners were armed with

Patna High Court Cr.Misc. No.13780 of 2016 (2) dt.01-04-2016 2/2 any weapon. The only accused alleged to be armed with Lathi is one Bukka Singh @ Chandeshwari Singh. It is further contended that no injury was caused to the informant of the case and the FIR was instituted due to ongoing land dispute between the parties. Learned counsel for the State has opposed the application for grant of pre-arrest bail to the petitioner. Regard being had to the facts and circumstances of the case, in the event of arrest or surrender in the court below within four weeks from today, the petitioners, namely, Sonu Singh, Uchit Singh, Mangal Singh, Sanoj Singh, Kailash Singh and Niraj Singh are directed to be released on bail on furnishing bail bonds of Rs.

10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Ankur Gupta, learned Judicial Magistrate, 1st Class, Khagarai in connection with Gogari (Paura O.P.) P.S.Case No.193 of 2015 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J) Md.S.
