JUSTICE AMARESH KUMAR LAL ORAL ORDER 21-01-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 408, 409, 420 of IPC.
It is submitted that during investigation many witnesses have stated that the petitioner was not present at the time of disbursing the amount of old age pension by Mukhiya. The petitioner has no criminal antecedent.
Considering the facts and circumstances, in case of arrest or surrender within a period of four weeks the above named petitioner will be enlarged on bail on furnishing bail bond of
Patna High Court Cr.Misc. No.32230 of 2014 (2) dt.21-01-2015 2/2 Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in Madhepura (Bharrahi O. P.) P. S. Case No. 720 of 2013 , subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure and the other following conditions:- (i) The petitioner will not indulge himself in similar or any other offence.
(ii) One of the bailors must be the close relative of the petitioner.
(iii) The petitioner will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, his bail bond would be liable to be cancelled by the learned Court concerned.
