JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 04-05-2016 Heard learned counsel for the petitioner and the learned Addl. Public Prosecutor, appearing on behalf of the State. This application for grant of anticipatory bail arises out of Chandradeep P.S.Case No. 90/2015, disclosing offences under sections 409, 420, 467, 468, 471, 472 and 34 of the Indian Penal Code.

It is alleged that the accused Jagannath Rajak in conspiracy with the present petitioner misappropriated a sum of Rs.7,91,118/- from the account of Middle School, Aliganj School Education Committee. The said Jagannath Rajak was the Incharge Headmaster of the said school and the amount so misappropriated is said to have been deposited in the account of the petitioner.

Patna High Court Cr.Misc. No.14725 of 2016 (2) dt.04-05-2016 Learned counsel, appearing on behalf of the petitioner, has submitted that the petitioner is ready to deposit the said amount of Rs. 7,91,118/- in the account of Aliganj Vidyalaya Shiksha Samiti (Account No. 11872857802, State Bank of India, Aliganj) within four weeks from today.

Considering the aforesaid stand taken on behalf of the petitioner, this application is allowed.

Let the petitioner, abovenamed, in the event of his arrest/ surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Devraj, Judicial Magistrate, 1st Class, Jamui in Chandradeep P.S.Case No. 90/2015, subject to the conditions as laid down under section 438(2) of the Cr.P.C. This is subject to the condition that the petitioner shall present himself before the police/ court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
