The petitioners seek bail in a case registered for the offence punishable under Sections 399, 402 and 414 of the Indian Penal Code and Sections 25 (1-b)a, 26 and 35 of the Arms Act.
The prosecution case in brief is that on seeing the police party five miscreants started to flee away but on chase two miscreants were apprehended and three succeeded in fleeing away taking advantage of the darkness. The apprehended accused persons disclosed the name of the petitioners and also disclosed the name of the accused persons, who fled away. On

No.35185 of 2020(3) dt.18-01-2021 2/2 search from the petitioner no. 01 a loaded country made pistol with one live cartridge and one cartridge from his pocket and from petitioner no. 02 two live cartridges were recovered. Apprehended accused also disclosed that they all five persons had come on a Alto Car and were making plant to commit loot in a jewelery shop at Jandaha Bazar.
Learned counsel the petitioners that the petitioners are innocent and have falsely been implicated in this case. The petitioners are in custody since 11.07.2020 and have got no criminal antecedent.
Learned APP for the State opposes the prayer for bail of the petitioner.
In the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (rupees twenty five thousand) each with two sureties of the like amount each in connection with Jandaha P.S. Case No. 103/2020 to the satisfaction of the learned Sub Divisional Judicial Magistrate, Hajipur (Vaishali). (Anjani Kumar Sharan, J) amitkumar/- U T
