The petitioner seeks bail in connection with Kotwali P.S. Case No. 435 of 2019, dated 16.09.2019, instituted for the offences under Sections 399, 402 and 414 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.
Patna High Court CR. MISC. No.35922 of 2020(2) dt.22-01-2021 2/2 The petitioner has not been arrested from the spot but his name is stated to have been taken by the arrested accused persons. Obviously, therefore, there is no recovery from him.
Learned counsel for the petitioner states that only because of his past antecedents, he has been made accused in this case.
In some of the cases in which the petitioner has been made accused earlier, he has been granted bail. The petitioner is stated to be in custody since 20.02.2020.
Considering the facts afore-stated, the petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate-Ist Class, Gaya in connection with Kotwali P.S.
